EB-5 Return of Capital – Legal Risk Notice
Under the EB-5 Reform and Integrity Act of 2022 (RIA), the return of capital to investors is allowed once job creation has been met and the I-829 petition has been filed. However, while this new guidance offers greater clarity, it does not eliminate all legal uncertainty. The U.S. government may issue new interpretations, and adjudicators may apply standards inconsistently. Therefore, while investments may be structured for early capital return post job-creation, VisaV Inc. cannot guarantee repayment timelines or outcomes, and investors should review all offering documents carefully with independent U.S. legal counsel.
